ICC Appeals of the Proposed 2024 International Energy Conservation Codes Sets Filing Deadline of December 3, 2023.

In last week’s update, we reported that the International Code Council Board of Directors had approved the appeals process for the proposed 2024 Editions of the International Energy Conservation Code (IECC) for both commercial and residential buildings and homes. Today, the ICC staff issued the following notification that the IECC development process had reached the stage when appeals to both the commercial and residential proposed 2024 editions was now available:

“The Final Result of the balloting process of the Commercial Consensus Committee on the Committee Action Report on Comments to Public Comment Draft #2 of the IECC Commercial was the approval of all balloted code changes by a 2/3 vote in accordance with Section 9.4 of the ICC Consensus Procedures. The approved code changes will be incorporated into the final draft of the 2024 IECC Commercial. The submittal period for appeals now commences in accordance with  Council Policy #1. The deadline for complete submittal of appeals is Sunday, December 3 at 11:59 pm Pacific.

Similarly, the Final Result of the balloting process of the Residential Consensus Committee on the Committee Action Report on Comments to Public Comment Draft #2 of the IECC Residential and IRC Chapter 11 was the approval of all balloted code changes by a 2/3 vote in accordance with Section 9.4 of the ICC Consensus Procedures. The approved code changes will be incorporated into the final draft of the 2024 IECC Residential and IRC Chapter 11. The submittal period for appeals now commences in accordance with  Council Policy #1. The deadline for complete submittal of appeals is Sunday, December 3 at 11:59 pm Pacific.

Earlier this month the ICC Building Safety Journal included highlights from the ICC Board of Directors Fall 2023 Meeting. Included in the article is information related to the IECC appeals process (following Section 4.1 of Council Policy #1). Staff will be following up with further information on these matters including continuous maintenance. Please note the updates to Council Policy #28 noted in the article are not applicable to the IECC as it is developed through CP#7 and CP#12.”

The notification provides specific information on filing appeals and states that the filing deadline is December 3, 2023.  AGA will be filing appeals on the proposed final draft of the 2024 IECC Commercial Code and the final draft of the 2024 IECC Residential and IRC Chapter 11 Codes. The AGA BECS Committee staff is in the process of developing a complete list of concerns with the proposed 2024 IECC codes. Shortly, we will provide additional information to the BECS Committee on our appeals approach and justification for the appeals mainly on procedural and content issues that we have documented and identified as inappropriate in the code development process including concerns with modifications of the Scope provisions during the code development process, lack of a proper cost effectiveness analysis on new energy provisions,  committee balance, etc.   We will also be working with other groups who also have concerns with the proposed 2024 IECC provisions to assess possible joint efforts to make the appeals as complete, effective and successful as possible.
